OZONE TRANSPORT AND ITS IMPACT ON WEST MICHIGAN

Please plan to join us at Frederik Meijer Gardens in Grand Rapids as representatives of EPA Region 5 and LADCO will be presenting the results of the much heralded ozone transport study. Also participating in the program will be key representatives of the MDEQ and Consumers Energy.

The Ozone Transport Study was commissioned by the Energy Policy Act of 2005. ThiFor the s law required EPA to conduct a demonstration project to address the effects of transported ozone and ozone precursors on Southwest Michigan. EPA, with assistance from LADCO and MDEQ, prepared its report based on the latest air quality monitoring and modeling data for the southern Lake Michigan region.

Related issues include designations under the new ozone standard, and re-designations under the old ozone standards for upwind and downwind areas in the southern Lake Michigan region. Also of significance is the recent D.C. Circuit Court’s decision to reverse its previous decision to vacate EPA’s Clean Air Interstate Rule.

Understanding Michigan’s New Renewable Portfolio Standard

WM-AWMA Luncheon Program

The Michigan Legislature approved a long-awaited Renewable Portfolio Standard (RPS) on September 18, 2008. Michigan State Senator, Patty Birkholz, a principal moving force behind this legislation, is well positioned to explain the “hows” and the “whys” of this new direction for encouraging “green energy” in Michigan.  
This standard is being touted as moving Michigan into the 21
st Century in terms of alternative energy development, creating associated jobs, and helping to control energy cost increases. Critics claim either:

  • The costs of the RPS will substantially increase utility customers’ costs and make it less economically desirable for businesses to locate or expand in Michigan; OR

  • The RPS does not go far enough to encourage alternative energy in the state.

Please plan to join us at noon on October 15, 2008 at Frederik Meijer Gardens, as State Senator Patty Birkholz will be speaking to us on her thoughts and insights on this very important piece of legislation. Joining Sen. Birkholz in the Q&A portion of the program will be Bruce Goodman of the Varnum Law firm who has been involved in alternative energy law for over fifteen years.

Carbon Sequestration

Assessment of Geological Carbon Storage Capacity in the Michigan Basin

Speaker:  David Barnes, Ph.D.

Dr. David Barnes, Professor of Geosciences at Western Michigan University, is a principal research scientist at the Michigan Geological Repository for Research and Education, and is the project director for the Michigan Basin Geological Carbon Storage Study in the Midwest Regional Carbon Sequestration Partnership.  Dr. Barnes will be discussing the Michigan basin carbon storage capacity and feasibility relative to stationary source carbon emissions potential.

All Appropriate Inquiry Regulations - Panel Discussion

This program features a panel discussion on the new All Appropriate Inquiry (“AAI”) Regulations that were promulgated by the United States Environmental Protection Agency on November 1, 2005.  The new AAI regulations will replace the current ASTM standards for purposes of determining whether due diligence requirements have been satisfied under the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”).  The panel, comprised of John Barkach from the Great Lakes Environmental Center, Matt Eugster from Varnum, Riddering, Schmidt & Howlett, and Nannette Leemon from the Michigan Department of Environmental Quality, will discuss significant changes required by AAI regulations and their effect on environmental due diligence.
